Terms of Service

These terms are the agreement between you and Pixport, Inc. for using our platform. We kept them as readable as we could — if anything is unclear, email us at legal@pixport.com before you agree.

Agreement and eligibility

By creating an account or using Pixport, you agree to these Terms of Service and our Privacy Policy. If you are signing up on behalf of a business, you confirm you have authority to bind that business to these terms.

You must be at least 18 years old and legally able to enter contracts to use Pixport. The service is designed for business use, not personal or consumer use.

Your account and security

You agree to provide accurate information when you sign up and to keep it current. You are responsible for safeguarding your password and for all activity that happens under your account, including activity by team members you add.

Two-factor authentication (2FA) is available on every account and we strongly recommend enabling it. If you suspect unauthorized access, tell us right away at legal@pixport.com and we will help you lock things down.

Free trial

Every new account gets a 14-day free trial with full access to all features. No credit card is required to start, and nothing is charged when the trial ends — your account simply pauses until you subscribe.

If you subscribe during or after your trial, everything you set up — customers, jobs, photos, templates — is kept exactly as you left it.

Subscriptions and billing

Pixport is billed monthly or annually through Stripe. Annual plans include a 20% discount compared to paying month to month. Subscriptions renew automatically at the end of each billing period unless you cancel first.

Prices are listed exclusive of taxes; where we are required to collect sales tax, VAT, or similar taxes, they are added at checkout. If we change our pricing, we will give you at least 30 days' notice before the new price applies to your account.

Cancellation and refunds

You can cancel anytime from your account settings — no phone calls, no retention scripts. Cancellation takes effect at the end of your current billing period, and you keep full access until then.

We do not provide prorated refunds for unused time on monthly or annual plans. After cancellation, you have a 30-day window to export your data before it is deleted under our Privacy Policy.

Payment processing

Payments you collect from your customers through Pixport are processed via Stripe connected accounts. To accept payments, you must create a Stripe account and agree to Stripe's own terms of service, including the Stripe Connected Account Agreement.

Stripe's standard processing fees apply to transactions. Pixport does not add any markup on top of Stripe's fees. Stripe — not Pixport — is responsible for moving money, and payouts are subject to Stripe's schedules and requirements.

SMS and communications

Pixport lets you send and receive text messages with your customers. You are responsible for obtaining any consent required before texting your customers, and for honoring opt-out requests promptly.

You agree to comply with applicable communications and anti-spam laws, such as the TCPA in the United States. Pixport's texting features are for conversational business communication — not bulk marketing. See our Fair Usage Policy for details.

Your content and data

You own your data — your customer records, job details, photos, documents, and messages. We claim no ownership over any of it.

You grant Pixport a limited license to host, store, process, and transmit your content solely to operate and improve the service for you. That license ends when you delete the content or close your account, except as needed for backups and legal compliance.

Acceptable use

You agree not to use Pixport for anything unlawful, to send spam or unsolicited bulk messages, to upload malicious code, or to infringe anyone's rights.

You also agree not to reverse engineer the service, probe or bypass its security, resell or sublicense access to Pixport, or use automated tools to scrape or bulk-extract data other than through our supported export features and API.

AI features

Pixport includes AI-powered features such as photo categorization and an AI assistant. These features are assistive: they can make mistakes, and their output is not professional, legal, or financial advice.

You are responsible for reviewing AI-generated suggestions, categorizations, and drafts before relying on them or sending them to your customers.

Intellectual property

Pixport — including our software, design, logos, and documentation — is owned by Pixport, Inc. and protected by intellectual property laws. These terms give you a limited, non-exclusive, non-transferable right to use the service; they do not transfer any ownership to you.

If you send us feedback or suggestions, we may use them to improve Pixport without obligation to you — though we genuinely appreciate them.

Availability and disclaimers

We work hard to keep Pixport fast and reliable, and we target high uptime. But no service is perfect: Pixport is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or that data loss will never occur — which is one reason we make exporting your data easy.

Limitation of liability

To the maximum extent permitted by law, Pixport's total liability for any claims arising out of or related to the service is capped at the amount you paid us in the 12 months before the event giving rise to the claim.

Neither party is liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, even if advised of the possibility. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Termination

You can stop using Pixport and close your account at any time. We may suspend or terminate your account if you materially breach these terms, fail to pay, or use the service in a way that harms Pixport or other customers — and where practical, we will warn you first and give you a chance to fix the issue.

On termination, your right to use the service ends, and data export and deletion are handled as described in these terms and our Privacy Policy.

Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Any disputes will be resolved in the state or federal courts located in Texas, and both parties consent to their jurisdiction.

Changes to these terms

We may update these terms from time to time. For material changes we will notify you by email or in the app at least 30 days before they take effect. Continuing to use Pixport after a change takes effect means you accept the updated terms.
